WashaHost Ltd. Hosting Services Terms and Conditions

1. Introduction

WashaHost Ltd. (“WashaHost,” “we,” “us,” or “our”) is a company incorporated under the laws of the Republic of Rwanda, providing hosting, domain registration, SSL certificates, email, and other internet-related services to individuals and businesses worldwide.

These Terms of Service (“Terms”) govern your access to and use of our hosting, domain registration, and related services (“Services”). By subscribing to or using any of our Services, you (“you,” “your,” or “Customer”) agree to these Terms in full. Please read them carefully before using our Services.

These Terms form a legally binding contract between you and WashaHost Ltd. and govern your relationship with us. If you do not agree to these Terms, please do not use our Services.

2. Official Communication

The only official communication channel we accept for all contractual, billing, technical, and legal correspondence is our official email address: info@washahost.com.

While other communication methods (phone, messaging apps, social media) may be used for informal contact, only emails sent from or received to this official email address will be recognized as valid for any formal requests, notices, or disputes. Customers acknowledge and agree to this policy and waive any claims based on communication from unverified or unofficial channels.

3. Account Registration and Eligibility

  • You must be at least 18 years old or the age of majority in your jurisdiction to use our Services.

  • When creating an account, you agree to provide accurate, current, and complete information.

  • You are responsible for maintaining the confidentiality of your account credentials, and all activities conducted under your account.

  • You must notify us immediately if you suspect any unauthorized use of your account.

4. Service Description

4.1 Hosting Services

  • Shared Hosting: Resources are shared across multiple customers; suitable for small to medium websites.

  • Virtual Private Servers (VPS): Dedicated virtualized server resources for more control and performance.

  • Dedicated Servers: Physical servers fully dedicated to your use.

  • Cloud Hosting: Scalable and resilient cloud-based hosting solutions.

  • Email Hosting: Professional email services linked to your domain.

  • Backup Services: Optional backup and restore solutions.

  • Other Services: Domain registration, SSL certificates, website builders, and related services.

4.2 Service Availability

  • We strive to maintain 99.9% uptime but do not guarantee uninterrupted service.

  • Scheduled maintenance, emergency repairs, or third-party issues may cause temporary service interruptions.

  • We reserve the right to suspend or modify Services for maintenance, upgrades, or security purposes.

5. Customer Obligations and Use Restrictions

  • You agree to use the Services only for lawful purposes and in accordance with all applicable Rwandan laws, including but not limited to the Data Protection and Privacy Law No. 058/2021.

  • You shall not use our Services to:

    • Upload or distribute illegal, offensive, or infringing content.

    • Transmit spam, malware, or viruses.

    • Engage in phishing, hacking, or unauthorized access attempts.

    • Violate intellectual property rights.

    • Conduct any activities that threaten the security or stability of our network or servers.

  • We reserve the right to investigate violations and suspend or terminate your account without prior notice.

6. Payment Terms and Billing

  • Service fees and billing cycles are detailed on our website and your account dashboard.

  • Payments are due in advance and are non-refundable unless otherwise stated.

  • Late payments may result in suspension or termination of your Services.

  • You authorize WashaHost to charge your payment method automatically according to your selected billing cycle.

  • All prices are exclusive of applicable taxes, which you are responsible for.

7. Domain Registration and Management

  • Domain registrations are subject to the policies of ICANN and the relevant domain registries.

  • You are responsible for maintaining accurate contact information for your domains.

  • Transfers, renewals, and cancellations follow the procedures set forth by registries and registrars.

  • We are not responsible for any loss or damage resulting from domain disputes, expiration, or failure to renew.

8. Data Protection and Privacy

  • WashaHost complies with Rwanda’s Data Protection and Privacy Law No. 058/2021.

  • We collect personal data necessary to provide and improve Services, including billing and technical information.

  • Your data will be stored securely and processed only for legitimate business purposes.

  • You have the right to access, correct, delete, or object to the processing of your personal data by contacting our Data Protection Officer at [Insert Email].

  • Data may be transferred outside Rwanda but protected by contractual or legal safeguards.

9. Security

  • We implement industry-standard technical and organizational measures to protect your data and our infrastructure.

  • You are responsible for securing your own accounts, passwords, and any content uploaded or managed via our Services.

  • In the event of a security breach, we will notify affected customers in accordance with applicable law.

10. Backup and Data Retention

  • We provide optional backup services and retain backups for up to 7 days.

  • Customers are responsible for their own data backup.

  • We do not guarantee data recovery or restoration.

  • We recommend maintaining your own offsite backup copies at all times.

11. Termination and Suspension

  • We may suspend or terminate Services if you breach these Terms, fail to pay, or engage in illegal or harmful activities.

  • Upon termination, your access to Services will cease, and your data may be deleted after a grace period.

  • You may terminate Services at any time by following cancellation procedures on your account or contacting Support.

  • Refunds, if applicable, will be processed in accordance with our refund policy.

12. Limitation of Liability and Risk Mitigation

  • Services are provided “as is” without any express or implied warranty of any kind, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. WashaHost does not guarantee uninterrupted or error-free service.

  • WashaHost’s total liability arising from or related to these Terms, whether in contract, tort, negligence, or otherwise, shall not exceed the total fees paid by you to WashaHost in the six (6) months preceding the event giving rise to the claim.

  • Under no circumstances shall WashaHost be liable for indirect, incidental, special, punitive, or consequential damages, including loss of revenue, data, goodwill, business interruption, or profits.

  • You waive any right to initiate or participate in any class, collective, or representative action against WashaHost. You also waive any right to a trial by jury.

  • All disputes shall be resolved by final and binding arbitration held in Kigali, Rwanda, in accordance with Rwanda Arbitration Law.

  • You consent to exclusive jurisdiction and venue in courts located in Kigali solely for enforcement of arbitration awards or interim relief.

  • You agree to indemnify, defend, and hold harmless WashaHost, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including attorney fees) arising from your breach of these Terms or improper use of the Services.

  • WashaHost reserves the right to suspend or terminate your account immediately and without prior notice upon suspicion of abuse, breach of terms, fraudulent activity, or threats to network stability or security.

13. Governing Law and Dispute Resolution

  • These Terms are governed exclusively by the laws of the Republic of Rwanda, excluding conflict of law rules.

  • Any disputes arising from or relating to these Terms or your use of Services shall be resolved by binding arbitration in Kigali, Rwanda, administered by a recognized arbitration institution under Rwanda Arbitration Law.

  • Arbitration will be conducted by a single arbitrator appointed by mutual agreement or, failing that, by the arbitration institution.

  • The arbitration process and outcome will remain confidential.

  • Enforcement of arbitration awards and any interim relief shall be under the exclusive jurisdiction of courts in Kigali, Rwanda.

14. Force Majeure

We are not liable for failure or delay due to events beyond our reasonable control, including natural disasters, acts of government, labor disputes, internet outages, or other unforeseeable events.

15. Amendments

We may update these Terms at any time by posting revised Terms on our website. Continued use after changes constitutes acceptance. We encourage you to review the Terms regularly.
